Auctions Terms and Conditions

All auctions will be subject to a 15% Buyer’s Premium.

Online bidding during the Live Auction is a fast process, and therefore there is no confirmation given - bids will be taken immediately and are irrevocable.

The highest bidder shall be the purchaser.

No bidder shall retract their bid. In the event of a dispute between two or more bidders, the auctioneer, at his sole discretion may put the lot up for resale to the highest bidder.

A bidder is deemed to have accepted the condition and description of an item when making a bid.

The auctioneer reserves the right to withdraw any lot at any time prior to the time of sale of such lot.

The auctioneer reserves the right not to accept any bid which is only a partial advance over the preceding bid.

The auctioneer may break down or consolidate any lot or lots at his sole discretion.

ebidz.ca Auctions assumes no responsibility for any liability once a bid is accepted. It is recommended that bidders arrange insurance for their purchases in advance.

Except as set out herein, there shall be no warranties or guarantees expressed or implied, statutory, or otherwise of any nature.

Please take advantage of in person viewing as all items are sold "As Is, Where Is" - catalogues are prepared only as a guide. No sale shall be invalidated by any reason or defect or inaccuracy of description in catalogue or otherwise, and no liability shall be borne by the auctioneers by virtue of any such fault or error. All sales are final.

Attendance at the auction viewing, or removal of purchased lots by purchaser/bidders and guests is done at their sole risk. ebidz.ca Auctions assumes no risk or liability, statutory, common law or otherwise whatsoever for the safety of those attending at the auction premises.

All purchased lots must be paid for on day of sale by direct deposit, e-transfer or by credit card. If you would prefer to use your credit card on file, please call us at 778-991-1958 and let us know to charge the credit card on file. online only for purchases under $999. Internet bidders’ payment is due in full by the end of the Auction by 6:00pm on Auction Day.

15% Buyers Premium and all applicable excise and sales taxes shall be added to the purchase price.

The purchaser/bidder is not entitled to possession until all purchased lots have been paid for in full. If the purchase prices are not paid within the prescribed time, the auctioneer shall have the right to resell such items in whatever manner he sees fit without notice to the purchaser/bidder. Any shortfall from sale plus commission and expenses thereof shall be paid by the purchaser/bidder.

All costs and responsibilities of removal shall be borne by the purchaser/bidder within the time prescribed by the auctioneer. The auctioneer may require proof of adequate insurance from the purchaser/bidder. The purchaser/bidder hereby indemnifies the auctioneer, ebidz.ca Auctions and the vendor of the purchased lot against all damages arising from the dismantling and removal of any purchased lot.

Any lots not removed within the prescribed time shall be subject to storage, moving, disposal and service charges at the sole risk and expense of the purchaser/bidder. All such lots shall be deemed as abandoned and shall be subject to resale for the recovery of such charges. The purchaser/bidder shall also be liable for any rent or damages sustained by the auctioneer for failure to remove any purchased lot.

Where the bidder is an individual representing an incorporated company, that individual certifies that he/she is authorized to represent and bind that company for the purpose of bidding and purchasing in this auction. Where the bidder is an individual representing an unincorporated business, the individual will be personally liable for all amounts owing to ebidz.ca Auctions.

The purchaser/bidder hereby grants to ebidz.ca Auctions a security interest as defined in the Personal Property Security Act of BC (PPSA) in all its present and after acquired personal property (collateral) to secure any unpaid amounts due and owing by the purchaser/bidder. The purchaser/bidder acknowledges that ebidz.ca Auctions may register a financing statement at the Personal Property Registry of BC in relation to the security interest, regardless of whether the purchaser has chosen to take delivery of the purchased lot. The purchaser/bidder acknowledges that acceptance by the purchaser/bidder of the terms and conditions of this auction will constitute a security agreement under the PPSA. The purchaser/bidder further acknowledges that the security agreement gives lien rights to ebidz.ca Auctions over all the purchaser/bidder’s personal property assets, which may include but is not limited to the purchased lot, if the purchaser/bidder refuses to pay in full for the purchased lot, and that ebidz.ca Auctions may take all enforcement action and other remedies available to it under the PPSA.

If for any reason, ebidz.ca Auctions is unable to deliver any or all purchased lot or title thereof, the sole liability of ebidz.ca Auctions shall be the refund of any monies paid to ebidz.ca Auctions on the purchased lot.

It is the sole responsibility of the purchaser/bidder to remove their purchased lots within the prescribed time. ebidz.ca Auctions will NOT provide any delivery or transport of any nature for live auction items.

When bidding for an item that has quantity greater than 1, if purchaser/bidder is successful, purchaser/bidder will receive one of the groupings, not necessarily the first lot.
